1. Overview
Thank you for choosing Kingspan Water and Safe Storage Inc. This Shipping Policy outlines the terms, conditions, and procedures governing the delivery of Kingspan Water and Safe Storage Inc. products purchased through our USA website, operated from Texas.
Kingspan Water and Safe Storage Inc. are purpose-built insulated truck bodies and refrigerated vehicle solutions manufactured by Kingspan. Due to the size, weight, and specialist nature of these products, all shipments are fulfilled on a pallet basis via approved freight carriers. This policy should be read alongside Kingspan’s full Terms & Conditions of Sale.
2. Shipping Coverage Area
2.1 Domestic Shipping
Kingspan Water and Safe Storage Inc. sells and ships currently within the state of Texas. All orders must be placed for delivery to a Texas address. For out-of-state or international enquiries, please contact Kingspan directly at sales@tanks-direct.us
2.2 Out-of-State and International Orders
Orders with delivery addresses outside Texas — including other US states, Alaska, Hawaii, and all international destinations - will be available upon request. For out-of-state or international enquiries, please contact Kingspan directly at sales@tanks-direct.us
3. Shipping Arrangements & Applicable Incoterms
3.1 Standard Delivery (B2C — DAP)
For consumer purchases (Business-to-Consumer / B2C), delivery is made on Delivered at Place (DAP) terms. This means Kingspan arranges and bears the cost of freight to the named delivery address. Risk passes to the Buyer upon delivery at the agreed Delivery Address in accordance with clause 8 of the T&Cs.
3.2 Business Customer Shipping Arrangements (B2B — FCA)
In a business-to-business (B2B) context, a Buyer may wish to arrange their own shipping and collection. Where this is agreed in writing by Kingspan prior to order confirmation, Free Carrier (FCA) Incoterms 2020 will apply. Under FCA terms:
• The Buyer is responsible for arranging and funding freight from Kingspan’s Texas facility.
• Risk passes to the Buyer when the goods are handed to the Buyer’s nominated carrier at Kingspan’s premises.
• Kingspan must agree to FCA terms in writing before the order is placed; requests cannot be made after an order has been confirmed.
If no shipping arrangement has been agreed in writing, standard DAP terms will apply regardless of the nature of the Buyer and the buyer will be responsible for shipping costs, duties and taxes.
4. Pallet Shipping
4.1 Why Pallet Shipping?
All Kingspan Water and Safe Storage Inc. products and associated components are shipped on pallets. Pallet shipping ensures:
• Safe transit and handling of large-format, heavy products
• Reduced risk of damage during loading, unloading, and in-transit movement
• Compliance with carrier regulations for oversized or heavy freight
• Consistent delivery experience across all order types

4.3 Multi-Pallet Orders
Larger or bulk orders may ship on multiple pallets. All pallets for a single order will be dispatched together where possible. In the event of a split shipment, the Buyer will be notified in advance with individual tracking references for each pallet.
5. Freight Carriers
Kingspan partners with reputable LTL (Less-Than-Truckload) and FTL (Full-Truckload) freight carriers to ensure reliable delivery across Texas. Deliveries are made using articulated vehicles as the standard method. Kingspan reserves the right to use other vehicle types at its discretion.
Kingspan selects the most appropriate carrier for each shipment based on destination, order volume, and service availability. If the Buyer has specific vehicle requirements or site access limitations (e.g. restricted road access, low bridges, weight limits), these must be communicated to Kingspan as a Delivery Constraint at the time of order confirmation. Kingspan cannot be held responsible for failed or delayed deliveries where relevant site constraints were not disclosed.
6. Order Processing & Lead Times
6.1 Order Processing
Orders are processed Monday through Friday, excluding US federal holidays. Orders received before 12:00 PM CST on a business day will be processed the same day. Orders received after 12:00 PM CST or on weekends and holidays will be processed the next business day.

Important — Lead Times Are Estimates Only All lead times stated above are estimates. Time and date for delivery shall not be of the essence unless previously agreed by Kingspan in writing. Kingspan will endeavour to deliver on the estimated date but may deliver in advance of that date upon giving reasonable notice to the Buyer. Kingspan shall not be liable for delays caused by carrier capacity, weather events, infrastructure disruptions, or any other cause beyond Kingspan’s reasonable control. See clause 11 (Force Majeure) below. |
7. Delivery Conditions & Site Requirements
7.1 Delivery Address & Access
Kingspan will deliver Goods to the Delivery Address specified at the time of order. The Buyer is responsible for ensuring:
• Adequate road access and clearance for articulated freight vehicles (53-foot trailer as standard)
• A level, firm surface suitable for pallet unloading
• A designated representative is present at the time of delivery to receive and sign for the goods
• Any site-specific access limitations are declared to Kingspan as a Delivery Constraint and accepted by Kingspan at order confirmation
7.2 Instalment Deliveries
Kingspan may elect to deliver the Goods in instalments. Where the Goods are to be delivered in instalments, failure by Kingspan to deliver any one or more of the instalments shall not entitle the Buyer to treat the contract as a whole as repudiated.
7.3 Liftgate Service
Standard delivery does not include liftgate service. If the Delivery Address does not have a loading dock or forklift, a liftgate service must be requested at the time of order. Liftgate service will incur an additional charge, which will be confirmed at the time of order confirmation.
7.4 Inside Delivery
Standard delivery is to curbside or dock level only. Inside delivery (movement of goods beyond the point of access) is not included as standard. Inside delivery may be arranged at the time of order and will incur an additional charge.
7.5 Residential Deliveries
Deliveries to residential addresses will incur a residential freight surcharge. This surcharge will be applied at checkout or confirmed prior to order processing. Buyers must notify Kingspan if the Delivery Address is a residential location.
7.6 Failed Delivery / Storage
If the Buyer fails to take delivery of the Goods, or fails to provide adequate delivery instructions at the time stated for delivery, Kingspan may:
• Store the Goods until actual delivery and charge the Buyer for all reasonable costs of storage (including insurance); or
• Sell the Goods at the best price readily obtainable and, after deducting all reasonable storage, insurance, and selling expenses, charge the Buyer for any balance required to make up the Total Price.
8. Order Tracking
Once an order has been dispatched, the Buyer will receive a shipping confirmation email containing:
• Order number and pallet reference(s)
• The name of the assigned freight carrier
• A PRO number or tracking reference for each pallet
• An estimated delivery window
Please allow up to 24 hours after dispatch for tracking information to become active within the carrier’s system.
9. Risk & Title
9.1 Passing of Risk
Risk of damage to or loss of the Goods shall pass to the Buyer at the time of delivery at the Delivery Address (where Kingspan delivers) or at Kingspan’s facility (where the Buyer collects under FCA terms). If the Buyer wrongfully fails to take delivery, risk shall pass at the time Kingspan has tendered delivery.
9.2 Retention of Title
Notwithstanding delivery and the passing of risk, title to the Goods shall not pass to the Buyer until Kingspan has received payment in full (in cleared funds) of the Total Price and all other amounts due under any other contract between the parties.
Until title passes, the Buyer shall hold the Goods as Kingspan’s fiduciary agent and bailee, keep the Goods separate and identifiable as Kingspan’s property, and maintain adequate insurance over the Goods.
Kingspan reserves the right to repossess Goods at any time before title passes. This clause does not apply where the Buyer is a Consumer.
10. Receipt, Inspection & Damage Reporting
10.1 Inspection on Delivery
It is the Buyer’s responsibility to inspect all Goods at the time of receipt. Before signing the carrier’s Proof of Delivery (POD), the Buyer must:
• Verify the number of pallets received against the delivery note
• Inspect all packaging and wrapping for signs of damage or tampering
• Note any visible damage, shortages, or discrepancies on the carrier’s delivery receipt before signing
10.2 Mandatory Notification Period

⚠ Mandatory Damage Notification — Strict 48-Hour Deadline The Buyer must notify Kingspan in writing of any damage, shortage, or defect within 48 hours of becoming aware of the same. Failure to notify Kingspan within this period shall mean the Buyer is not entitled to: (a) reject the Goods; (b) refuse payment; or (c) make any claim in respect of such damage or defect. This requirement is a condition precedent to any right of rejection or claim. Notification must be sent to: shipping@kingspan.com and must include the order number, pallet reference(s), a description of the damage, and supporting photographic evidence. |
Signing for a delivery without noting visible damage constitutes acceptance of the Goods in good condition as regards matters that were, or ought to have been, visible on inspection.
10.3 Kingspan’s Liability for Non-Delivery
If Kingspan fails to deliver the Goods for any reason other than Force Majeure or the Buyer’s fault, Kingspan’s liability shall be limited to the excess (if any) of the cost to the Buyer (in the cheapest available alternative market) of equivalent replacement goods over the Total Price of the Goods or refund of the original purchase price, whichever is the lesser.
11. Returns & Refunds
11.1 Consumer Cancellation Rights (B2C)
A Buyer who is a Consumer may cancel their order within 14 days of the date on which they receive the Goods (the “Cancellation Period”), where required by the FTC Cooling-Off Rule (16 C.F.R. Part 429) and applicable Texas consumer protection laws. To exercise this right:
• The Buyer must complete and submit a ‘Request a Return’ form on the Kingspan website within the Cancellation Period.
• Kingspan will acknowledge receipt by return email.
• Any refund due will be issued within 14 days of: (a) the day Kingspan receives notification of cancellation where the Goods have not been delivered; or (b) the day Kingspan receives the returned Goods in undamaged condition.
• Refunds will be made using the same method of payment as the original order.
11.2 Non-Returnable Goods
The right of cancellation does not apply to:
• Goods that are cut, mixed, or configured to the Buyer’s requirements
• Made-to-measure, made-to-order, or bespoke Goods
• Goods clearly personalised or manufactured to the Buyer’s specifications
11.3 Condition of Returned Goods
Where Goods are returned to Kingspan in a damaged or defective state (where such damage is not attributable to Kingspan and was not notified to Kingspan in accordance with clause 10.2 above), Kingspan reserves the right to deduct from any refund the amount required to restore the Goods to their original condition.
11.4 Return Authorisation & Freight
All returns require prior written authorisation from Kingspan. Unauthorised returns will not be accepted and may be returned to the Buyer at the Buyer’s expense. The Buyer must contact Kingspan’s customer service team to initiate a return and obtain a Return Authorisation Number (RAN) before dispatching any goods. Return freight costs are the responsibility of the Buyer unless the return is due to a product defect or a shipping error on Kingspan’s part.
11.5 Refusal of Delivery
If a delivery is refused by the Buyer without prior written authorisation from Kingspan, the Buyer may be liable for return freight charges and a restocking fee.
12. Shipping Costs
Shipping costs are calculated based on:
• Product weight, dimensions, and pallet count
• Delivery destination (ZIP code — Texas only)
• Carrier rates at time of dispatch
• Additional services requested (e.g. liftgate, inside delivery, residential surcharge)
For standard orders, shipping costs are displayed at checkout prior to order confirmation. For large, bulk, or custom orders, a separate freight quotation may be provided before order processing commences.

13. Force Majeure & Delays
Kingspan shall not be liable for any delay or failure to deliver the Goods where such delay or failure results from circumstances beyond Kingspan’s reasonable control, including but not limited to:
• Severe weather events, natural disasters, or acts of God
• Carrier strikes, labour disputes, or industrial action
• National emergencies, government actions, or regulatory restrictions
• Infrastructure disruptions, road closures, or port congestion
• Supply chain disruptions or shortage of materials
In such circumstances, Kingspan will communicate expected delays to the Buyer as soon as reasonably practicable and will use reasonable endeavours to reschedule delivery at the earliest opportunity.
